Aeroitalia can deny compensation when the disruption was caused by extraordinary circumstances, such as a third party or force majeure. Aeroitalia is not obliged to pay flight compensation in cases when they are not the party at fault for the delay or cancellation.
Some of the most common extraordinary circumstances are:
Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
A strike, most often specifically within the aviation industry (for example, a strike of air traffic control workers at a specific airport).
However, a strike of the airline's crew is not considered an extraordinary circumstance!
Political circumstances, such as a terrorist attack or general security risk due to political unrest.
Natural disasters, including volcanic eruptions and hurricanes.
A collision between the aircraft and birds or other foreign objects.
An ill or unruly passenger.
Flight delays caused by the airport staff, such as extraordinarily long queues to security checks.
How long do I have to claim my Aeroitalia compensation and refund?
Different national laws will apply depending on the itinerary of your flight. According to Italian law, you have 5 years to claim flight compensation. However, passengers can always choose the option that is most favourable to them.
It is therefore possible to claim under the law applicable in the country of departure or destination when it is not Italy. For instance, if you travel with Aeroitalia to the United Kingdom, you can claim flight compensation under British law, where you have 6 years to file a claim. Scotland is the exception where you would have 5 years to claim.

Aeroitalia is an Italian flag carrier founded in 2022. The airline, based in Forlì Luigi Ridolfi Airport (FRL) in northern Italy, between Bologna and Rimini-Rivera in Tuscany, received its Air Operator's Certificate on April 22, 2022. In July 2022, Aeroitalia began operating scheduled flights from its hub in Forlì to many domestic destinations, Malta, and Zakynthos.
