Your rights in the event of a delayed or cancelled Air India flight
Keep in mind that if you experienced Air India cancellations or delays, European and British laws protect your rights as an air passenger. These laws only apply if the airline is based in Europe or if the airline is not based in Europe but the flight departs from Europe. In this case, Air India is not based in Europe, so the latter condition applies.
- Was your Air India flight delayed? You are probably eligible for flight compensation if you arrived at your final destination a minimum of 3 hours late.
- Was your Air India flight cancelled? If you did not take an alternative flight supplied by the airline, or if no alternative flight was provided, you are entitled to a refund. Furthermore, if the flight was cancelled less than 14 days before departure, you may be eligible to receive Air India flight compensation.
- Regardless of the cause of the flight disruption, airlines are required to provide passengers with specific assistance, known as the "right to care." This includes vouchers for food and beverages, communication services (free telephone calls, fax messages, or emails), and, if necessary, hotels and transportation. You can claim them promptly at the airline's service counter at the airport; if the airline refuses to give you a voucher, simply go out and buy what you need — they will have to reimburse you for those costs (as long as they are reasonable).
Warning: If your flight was delayed or cancelled due to an "extraordinary circumstance," you will not be entitled to flight compensation. You can learn more about the examples of extraordinary circumstances further down this page.
Air India — Can I claim flight compensation with a non-EU airline?
You can claim Air India flight compensation under one of the following circumstances:
- You were travelling with an airline headquartered in the UK or the EU
- You were travelling with an airline headquartered outside of the UK or the EU, but the flight departed from the UK or the EU
Did your Air India flight depart from the UK or an EU country? If that was the situation and your flight was cancelled or delayed, you might be eligible for compensation.
If the flight disruption happened on your way back to the UK/EU, you are regrettably not entitled to compensation. See the table below for additional information.
Type of flight | Example | Compensation |
---|---|---|
Flying with a British carrier | Tokyo to London with British Airways | Yes |
Flying with a EU carrier | Amsterdam to London with KLM | Yes |
Flying with a non-UK/non-EU carrier from the UK | London to Tokyo with Japan Airlines | Yes |
Flying with a non-UK/non-EU carrier to the UK | Tokyo to London with Japan Airlines | No |
Air India missed connection flight due to a delay or cancellation
If you missed your connecting flight with Air India, you might also be eligible for compensation. Firstly, make sure that all flights related to your specific journey appear on one ticket. This step is critical in assessing whether you can claim Air India flight compensation. If you had two flights on completely separate tickets and missed the second flight because of the first flight's disruption, you are unlikely to receive compensation.
Additionally, the regular British and European air passenger rights criteria for compensation apply. This means that, in order to receive Air India flight delay compensation, missing a connecting flight must have resulted in you reaching your final destination with at least a 3-hour delay. Plus, at least one of the flights in question must have departed from the UK or the EU.
According to the British and EU regulations, you may well be eligible for €600 in flight compensation for your disrupted Air India flight!

How much Air India flight compensation can I get for a delayed or cancelled flight?
If your Air India flight departing from the UK/EU was delayed or cancelled, the airline might have to compensate for it. Keep in mind that this does not apply to Air India flights departing from countries other than the UK/EU. Compensation is given per passenger according to the flight's distance:
Distance of your flight | Compensation according to the UK261/EU261 |
---|---|
Flights shorter than 1,500 km | €250 per passenger |
Flight between 1,500 and 3,500 km | €400 per passenger |
Flights of over 3,500 kilometres within the EU | €400 per passenger |
Flights of over 3,500 kilometres outside of the EU | €600 per passenger |

When can I claim compensation for my cancelled Air India flight?
You might be entitled to Air India flight cancellation compensation if your flight was abruptly cancelled (fewer than 14 days before the original departure date).
This only applies to flights departing from the UK or the EU.
To be considered: Even if you meet the aforementioned standards, the airline may, in some cases, legitimately refuse to pay you compensation. See this article's "Extraordinary Circumstances" section for more details.
When can I claim a refund for my cancelled Air India flight?
If one of the following conditions are met, and your Air India flight from the EU is cancelled, you might be entitled to a refund:
- You weren't presented with the option of an alternative flight by the airline
- Although the airline did offer you a different flight, you turned it down.
You can find more information on the table below.
Cancellation notice | Alternative flight | Compensation |
---|---|---|
Fewer than 7 days in advance | Departs 1h+ earlier or arrived 2h+ later | Yes |
7-14 days in advance | Departs 2h+ earlier or arrived 4h+ later | Yes |
Fewer than 14 days in advance | No alternative flight offered | Yes + refund |
Can I get flight compensation if I cancel my Air India flight?
If you decide to cancel your Air India flight, keep in mind that you may be entitled to a refund, but you are NOT eligible for flight compensation under British air passenger rights rules and regulations. Visit Air India's website or call their customer service department to learn more about their refund and compensation procedures.

Extraordinary circumstances — can Air India deny me compensation?
Sometimes a third party or a situation involving force majeure, as opposed to the airline, is to blame for a delay or cancellation. These conditions fit the definition of extraordinary circumstances.
If one of the following cases applies to your case, Air India may decline to pay you compensation.
- Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
- Strike caused by workers within the aviation industry (e.g. baggage handlers).
However, a Air India strike caused by workers associated with the airline (e.g. flight attendants) is NOT considered an extraordinary circumstance! - Political circumstances, such as a terrorist attack
- Natural disasters, including wild fires and hurricanes.
- A delay or cancellation caused by an ill or unruly passenger.
Watch out! Airlines occasionally make claims that extraordinary circumstances transpired even when they didn't. To avoid being obliged to pay compensation, they act in this manner.
