Your rights in the event of a delayed or cancelled EVA Air flight
If you were a passenger on a cancelled or delayed EVA Air flight that departed from the EU/UK, your rights as an air passenger are secured by European and British law. In some situations, you may be entitled to compensation of up to €600, as well as a full refund for your cancelled EVA Air flight.
Was your EVA Air flight delayed? You can claim compensation if your flight was delayed by a minimum of 3 hours.
Was your EVA Air flight cancelled? You are entitled to a refund if you declined the airline's alternative flight. Furthermore, if your flight was cancelled with less than 14 days to departure, EVA Air may be obligated to pay you flight compensation.
Whatever the reason for the flight disruption, airlines are required by law to extend special assistance to passengers, known as the "right to care." Food and beverage vouchers, communication services and, if necessary, lodging and transportation are all provided. Claim the vouchers at the airline service counter at the airport, and if they dismiss your inquiry, buy what you need anyway; they will have to reimburse you for those charges (as long as they are reasonable).
Flight compensation is not payable if your flight is cancelled or delayed because of an "extraordinary circumstance." The airline must be to blame for the flight disruption in order to compensate passengers.
EVA Air — Can I claim flight compensation with a non-EU airline?
To be eligible for EVA Air flight compensation, your delayed or cancelled flight must have originated in the United Kingdom or the European Union.
Unfortunately, your passengers' rights are not protected by UK/EU legislation if you were flying to the UK/EU with a non-EU airline. More information can be found in the table below.

Flying with a non-UK/non-EU carrier from the UK | London to Tokyo with Japan Airlines | Yes |
Flying with a non-UK/non-EU carrier to the UK | Tokyo to London with Japan Airlines | No |

Flight between 1,500 and 3,500 km | Get £350 per passenger |

Extraordinary circumstances — can EVA Air deny me compensation?
Even if you think you should be eligible for flight compensation as your flight was delayed by 3+ hours or cancelled at the last minute, EVA Air has the right to deny you fight compensation if the disruption was caused by a third party or a force majeure. We refer to such situations as extraordinary circumstances.
Here are some examples of the most common extraordinary circumstances:
Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
A strike, most often specifically within the aviation industry (for example, a strike of air traffic control workers at a specific airport).
However, a strike of the airline's crew is not considered an extraordinary circumstance!
Political circumstances, such as a terrorist attack or general security risk due to political unrest.
Natural disasters, including volcanic eruptions and hurricanes.
A collision between the aircraft and birds or other foreign objects.
An ill or unruly passenger.
Flight delays caused by the airport staff, such as extraordinarily long queues to security checks.
Beware: Airlines can sometimes claim that an extraordinary circumstance occurred, even when this was not the case — and deny you fight compensation when you actually deserve it!
How long do I have to claim my EVA Air compensation and refund?
There is a time limit to submitting a flight compensation claim. The limit differs depending on:
The law of the country of origin
The law of the country of destination
The law of the country in which the airline is based
When flying from another country, different time limits may apply: if you were on an EVA Air flight from Amsterdam to Taipei, you can only submit a claim under Dutch law where you have 2 years to claim flight compensation.
