What are your air passenger rights in the event of a delayed or cancelled TUI flight?
In the European Union, your air passenger rights are protected by Regulation (EC) No. 261/2004. After Brexit, 'The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019' has been introduced in the UK in order to apply the EU261 regulation into the British law. These regulations guarantee that if your flight got significantly delayed or cancelled and the airline is the party at fault, you can claim compensation and — in the case of cancellations — also a flight refund.
Did you have a TUI flight delayed by at least 3 hours? Then you are likely entitled to TUI flight compensation of up to €600.
- Did TUI fly cancel your flight? If you did not take an alternative flight offered by the airline (or were not offered one at all), you can claim a ticket refund.
- Did TUI fly announce the flight cancellation fewer than 14 days prior to the original departure date? Then you might also be entitled to compensation of up to €600.
- No matter the reason of the flight delay or cancellation, TUI fly must provide special assistance (“right to care”) to the affected passengers. These rights include food and beverage vouchers, communication services (e.g. free phone calls, emails, or fax messages), and if necessary, accommodations and transportation. You can claim these at their service desk at the airport. If they refuse to provide the necessary care, you can also purchase the items and ask for reimbursement afterwards.
Warning: You are only eligible for flight compensation TUI if the disruption is at the fault of the airline. If the delay or cancellation was due to “extraordinary circumstances”, you may not be compensated.
Check your TUI fly flight status
To ensure a smooth travel experience, it is crucial to stay informed about the status of your TUI fly flight. By checking the flight status, you can promptly receive updates on any changes, delays, or cancellations that may impact your journey. You can do so by visiting TUI fly or the airport’s website and mobile app. To check for your flight status via the TUI fly website, simply enter your flight number, and the airports of your departure and arrival.

Extraordinary Circumstances – Can TUI fly deny my compensation or refund claim?
Unfortunately, airlines still often deny passengers their compensation and refunds. This happens especially to passengers not supported by a legal professional in the process. Airlines simply believe that such individuals won’t take the case to court to fight for their rights.
However, there are also a few situations in which the airline can rightfully deny you compensation and a refund. These are called extraordinary circumstances.
- Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
- Strike, specifically caused by workers within the aviation industry, but not related to the airline (eg. baggage handlers).
However, a TUI strike caused by workers associated with the airline (eg. pilots, flight attendants) is NOT considered an extraordinary circumstance! - Political circumstances, such as threats to security caused by political unrest.
- Natural disasters, such as flooding and wildfires.
- A delay or cancellation caused by an ill or unruly passenger.
Be aware that airlines often claim that extraordinary circumstances occurred even when they did not. They do so in order to avoid compensating passengers!
